The Food and Drug Administration’s (FDA) Food and Cosmetic Information Center (FCIC)/Technical Assistance Network (TAN) provided this information regarding cosmetic products such as lip balms:
Response: Under the law, cosmetic manufacturers are not required to register their cosmetic establishments or file their product formulations with FDA, and no registration number is required to sell or to import into the United States. As the name implies, the voluntary cosmetic registration program (VCRP) is voluntary. The manufacturer is solely responsible for ensuring the safety of the product. The manufacturing corporation is also required to ensure the product does not contain any prohibited ingredientsand it is properly labeled. Please note there are color additives that are approved for use in cosmetics and color additives (batches) that are subject to certification. The latter additives must be certified by our office of colors and cosmetics prior to being using in a cosmetic. Also keep in mind that if your product contains an active ingredient, or purports any claims it mitigates, treats or prevents a medical condition, it will be regulated by the FDA Center for Drugs Evaluation and Research.
